Does the child bring the claim herself?

No. A child under the age of 18 years cannot legally bring a lawsuit or make a claim. In Virginia, the lawsuit is made by the "next friend" of the child, usually one or both parents.

In fact, the child cannot choose her own lawyer; that, too, is up to the parents or other adult who has authority to act on the child's behalf.
