Q Who are the beneficiaries?
AThe beneficiaries of a wrongful death claim are not always the same family members who would inherit under a will. The Virginia wrongful death statute (§ 8.01-53) tells us who the beneficiaries are. For instance, if the person who was killed (the "decedent") was married, it would be the spouse; if the decedent was married and had children, it would be the spouse and children, etc. (These are examples only; the law is very detailed about identifying the beneficiaries.)
