Who pays for the life-long care needs of a severely injured child?

Virginia law provides that the careless person who causes the injuries is responsible for all of the injuries. However, many of the most severely injured children cannot be fully compensated for their injuries because Virginia also has financial limits on how much the wrongdoer ultimately pays. These limits are called "caps", and are frankly unjust for the most severely injured children, those that need compensation the most.

If the cost of a child's care goes beyond the caps for the case, the child's parents will have to resort to other means to take care of their child. Typically, parents who face astronomical future health care costs for a severely injured child must resort to government assistant programs.
